1Acceptance of Terms
By accessing, downloading, installing, or otherwise engaging with the WordHammer application, website, or any ancillary services provided heretofore or hereafter (collectively, the "Service"), you (the "User") hereby acknowledge that you have read, comprehended, and agree to be irrevocably bound by these Terms of Service ("Terms"), our Privacy Policy, and all auxiliary policies incorporated herein by reference.
In the event that you are accessing the Service on behalf of a corporate entity or other legal personage, you represent and warrant that you possess the requisite authority to bind said entity to these Terms. Notwithstanding the foregoing, references to "you" shall encompass both the individual user and any such entity.
Should you fail to provide your full and unconditional assent to these Terms, you are hereby instructed to immediately cease and desist from all use of the Service. Continued engagement subsequent to any amendments shall constitute a binding acceptance of the revised Terms.
2Description of Service
WordHammer facilitates a pedagogical environment through the provision of linguistic lessons, lexicographical resources, and performance analytics. The Service is rendered on an "as is" and "as available" basis, without any representations or warranties, express or implied, heretofore and hereafter.
We reserve the unilateral right to modify, suspend, terminate, or otherwise restrict access to the Service, either in colloquium or in part, at any time and without prior notification, and shall bear no liability in relation thereto.
The educational materials encompassed within the Service are provided for illustrative and self-improvement purposes exclusively. Notwithstanding any internal quality controls, we do not warrant the veracity, cogency, or suitability of any content for any particularized objective.
3Eligibility & Accounts
3.1 Age Requirement
You must be at least 13 years of age to use the Service. Users between 13 and the age of majority in their jurisdiction may only use the Service with verifiable parental or guardian consent. By creating an account you represent that you meet this requirement.
3.2 Account Registration
You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration.
- Update your information promptly if it changes.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activities occurring under your account.
We will not be liable for any loss arising from your failure to safeguard your credentials.
3.3 One Account per Person
You may not create multiple accounts to circumvent restrictions, bans, or usage limits. We reserve the right to merge or terminate duplicate accounts.
4User Conduct
You agree not to use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems.
- Introduce viruses, trojans, worms, or other malicious material.
- Engage in automated data scraping, crawling, or harvesting without our express written permission.
- Interfere with the proper functioning of the Service or impose an unreasonable load on our infrastructure.
- Reverse-engineer, decompile, or attempt to derive the source code of any portion of the Service.
- Submit false, misleading, or intentionally inaccurate dictionary edits or other content.
We reserve the right, in our sole discretion, to determine what conduct violates these rules and to take action including account suspension or termination.
5User-Generated Content
5.1 Content You Submit
Authorised users (Editors and Moderators) may propose and submit dictionary modifications ("User Content"). By submitting User Content, you:
- Represent that you own or have the right to submit the content, and that doing so does not violate any third-party rights.
- Grant WordHammer a perpetual, worldwide, royalty-free, irrevocable, sublicensable licence to use, reproduce, modify, publish, and distribute such content within the Service.
- Acknowledge that content is subject to review and may be accepted, rejected, modified, or removed at the sole discretion of our moderation team.
5.2 Content Standards
All User Content must be accurate, lawful, and appropriate for a general educational audience. You must not submit content that infringes intellectual property rights, is defamatory or offensive, or contains personal data of third parties.
5.3 No Liability for User Content
We do not pre-screen all User Content and are not responsible or liable for any User Content submitted by you or any other user. We expressly disclaim all liability in connection with User Content to the fullest extent permitted by law.
6Intellectual Property
6.1 Our IP
The Service โ including its software, design, layout, graphics, interface, and all content originating from WordHammer ("Our Content") โ is owned by or licensed to WordHammer and is protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service strictly in accordance with these Terms.
6.2 Restrictions
You may not copy, reproduce, distribute, republish, display, or transmit any of Our Content in any form except as expressly permitted. Any unauthorised use terminates the licence granted herein.
6.3 Feedback
If you submit feedback, suggestions, or ideas about the Service, you hereby assign all rights in such feedback to WordHammer. We may use it without restriction or compensation to you.
6.4 DMCA / Copyright Complaints
If you believe any content infringes your copyright, contact us (Section 18) with: (a) identification of the work; (b) location of the infringing material; (c) your contact information; (d) a good-faith statement that use is not authorised; (e) a statement of accuracy under penalty of perjury.
7Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS RENDERED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- Any implied warranty of merchantability, fitness for a particularized purpose, title, or non-infringement.
- Any warranty that the functionality of the Service shall be uninterrupted, synchronous, secure, or free from defect or error.
- Any warranty regarding the veracity, reliability, or exhaustiveness of any content or resultant data derived from the Service.
- Any warranty that any identified defects within the Service shall be rectified.
The User hereby acknowledges and agrees that any access to or utilization of the Service is conducted at their own discretion and risk, and the User shall be solely responsible for any deleterious effects resulting therefrom. Some jurisdictions preclude specific warranty exclusions; in such instances, the exclusions herein shall apply to the furthest extent of the law.
8Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE STATUTES, WORDHAMMER, ITS OPERATORS, AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE HELD LIABLE FOR ANY:
- Indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of pecuniary profits, data corruption, loss of goodwill, service interruption, or the procurement of substitute services.
- Damages arising from or relating to unauthorized access to your data, actions of unaffiliated third parties on the Service, or any other matter pertaining to the Service.
NOTWITHSTANDING ANY PROVISION TO THE CONTRARY, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING HEREUNDER SHALL NOT EXCEED THE GREATER OF: (A) THE SUM TOTAL ACTUALLY PAID BY YOU TO US DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE ACCRUAL OF THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).
These limitations shall apply irrespective of the legal theory invoked (contract, tort, negligence, strict liability, or otherwise), even if WordHammer has been previously apprised of the possibility of such damages. In jurisdictions precluding specific limitations, our liability shall be limited to the fullest extent permitted by law.
9Indemnification
You hereby agree to defend, indemnify, and hold harmless WordHammer and its operators, affiliates, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, encumbrances, and expenses (including, without limitation, reasonable legal and accounting fees) arising out of or in any way connected with:
- Your access to or utilization of the Service.
- Your breach of any covenant set forth within these Terms.
- Any User Content submitted by you hereto.
- Your infringement of any third-party rights, including but not limited to intellectual property or privacy protections.
We reserve the right, at our sole discretion, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate fully with WordHammer in asserting any available defenses.
10Subscriptions & Payments
10.1 Pricing
Current subscription pricing and plan durations are clearly outlined on our Pricing Page. We reserve the right to adjust pricing at any time. Any price changes will only apply to future billing cycles (or new term purchases), and we will provide reasonable advance notice of any recurring changes.
10.2 Complimentary Tier Access
Fundamental features of the WordHammer platform are rendered available on a complimentary basis. Users engaged with this tier may be subject to usage limitations and prophylactic restrictions at our sole discretion, including but not limited to session caps and a restorative heart-based system.
10.3 Paid Subscriptions
Certain premium features require a paid subscription. Where applicable, subscriptions are billed in advance on a recurring basis or as a fixed one-time payment. You are responsible for all charges incurred under your account.
10.4 No Refund Policy
All purchases are strictly final and non-refundable. We do not offer refunds, prorated credits, or chargebacks for any unused portion of a subscription, accidental purchases, or if your account is terminated due to a violation of these Terms.
10.5 Standard Cancellation Policy
You may cancel an automatic renewal or subscription at any time through our designated payment processor (e.g., Lemon Squeezy) or your account settings. Cancellation takes effect at the end of your current paid billing period; you will retain access to premium features until that duration expires.
11Termination & Violations
11.1 Termination for Material Breach
Any infringement, systemic abuse, exploitation of latent vulnerabilities, or material breach of the covenants contained within these Terms shall result in the immediate and irrevocable termination of your account credentials. In the event that a paid subscription is active at the time of said termination, all heretofore paid remunerations shall be forfeited to WordHammer, and no refunds or prorated credits shall be rendered.
11.2 Discretionary Termination by WordHammer
We reserve the unilateral and absolute right to suspend, truncate, or terminate your access to the Service immediately, with or without prior notification or liability, for any reason or no reason whatsoever. Upon such termination, all licenses and rights granted to you hereunder shall cease immediately.
11.3 Termination by the User
The User may elect to discontinue engagement with the Service at any time. To effectuate the permanent deletion of your account and associated datasets, you are instructed to contact us pursuant to Section 18. Such requests shall be processed within a reasonable temporal window, subject to any existing statutory retention mandates.
11.4 Survival of Provisions
Sections 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), 12 (Dispute Resolution), and 6 (Intellectual Property) shall survive the termination or expiration of these Terms notwithstanding the cause of such termination.
12Dispute Resolution & Binding Arbitration
12.1 Mandatory Informal Resolution
Prior to the initiation of any formal litigation or arbitration proceedings, you hereby agree to attempt an informal resolution of any dispute with WordHammer for a period of no less than thirty (30) calendar days subsequent to the provision of written notice to our designated contact address.
12.2 Agreement to Binding Arbitration
Should informal resolution prove unsuccessful, any and all disputes arising out of or relating to these Terms or the Service shall be adjudicated through final and binding individual arbitration, precluding any right to trial by jury or court proceedings, except as expressly provided in Section 12.4. Arbitration shall be conducted in the English language under the auspices of a recognized international arbitral forum.
12.3 Waiver of Class Action Participation
YOU AND WORDHAMMER EACH HEREBY EXPRESSLY WAIVE ANY AND ALL RIGHTS TO COMMENCE OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be asserted solely in an individual capacity and not as a member of any purported class or representative collective.
12.4 Equitable and Injunctive Relief
Notwithstanding the agreement to arbitrate, either party may seek immediate injunctive or other equitable relief within a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm, without first undergoing the informal resolution or arbitration processes described heretofore.
13Governing Law & Severability
These Terms shall be interpreted and governed in accordance with the laws of the jurisdiction of incorporation of WordHammer, notwithstanding any conflict-of-law principles. In any instance where arbitration is found unenforceable, both parties hereby submit to the exclusive personal jurisdiction of the courts of competent jurisdiction.
Should any provision of these Terms be adjudicated invalid, illegal, or otherwise unenforceable by a body of competent jurisdiction, such provision shall be severed or modified to the minimum extent necessary to render it valid. The remaining provisions heretofore mentioned shall continue in full force and effect notwithstanding such modification.
The failure of WordHammer to exercise or enforce any right or provision contained herein shall not constitute a waiver of such right or provision in any future instance.
14Privacy Policy
14.1 Data We Collect
- Account Data: Information provided at registration, such as name, email address, and basic profile details.
- Learning Progress: XP, levels, and course progress data stored to personalise your experience.
- Usage & Security Data: Technical identifiers and device information used for security monitoring, rate-limiting, and fraud prevention.
- Verification Data: Temporary identifiers sent for account verification and authentication.
- User Content: Contributions made to the dictionary or other community features.
We do not collect payment card data. Any payment processing is handled exclusively by third-party processors under their own privacy policies.
14.2 How We Use Your Data
- To create and manage your account and authenticate sessions.
- To deliver and personalise the educational features of the Service.
- To send transactional communications such as OTP codes and account notifications.
- To enforce these Terms, prevent fraud, and maintain security.
- To comply with applicable legal obligations.
- To generate aggregated, anonymised analytics to improve the Service.
14.3 Data Storage & Security
- Robust Encryption: We employ industry-standard encryption protocols for data both in transit and at rest.
- Access Controls: Strict internal policies and role-based access controls ensure that your sensitive data is only accessible to authorised personnel.
- Modern Safeguards: We use proven, high-standard security measures to protect your credentials and prevent unauthorised access.
- Anonymisation: Where possible, we use anonymisation and technical safeguards to protect your privacy and reduce data exposure.
While we implement robust, commercially reasonable safeguards to protect your information, no system is entirely infallible. We continuously monitor and improve our security posture to maintain the highest levels of protection.
14.4 Data Sharing & Third Parties
We do not sell, rent, or trade your personal data. We may share data only:
- With service providers processing data on our behalf under strict confidentiality agreements (e.g. hosting, email delivery).
- When required by law, valid legal process, or to protect safety.
- In connection with a merger or acquisition, provided the acquiring party agrees to honour this Privacy Policy.
14.5 Data Retention
We retain personal data for as long as your account is active or as needed to provide the Service. Guest session data is automatically deleted after 7 days of inactivity. Revoked authentication tokens are purged after their expiry date. You may request account and data deletion at any time (Section 11.2).
14.6 Your Rights (GDPR / CCPA)
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: Request a copy of the data we hold about you.
- Rectification: Request correction of inaccurate data.
- Erasure: Request deletion of your data, subject to legal retention obligations.
- Restriction & Objection: Request restriction of processing or object to processing based on our legitimate interests.
- Portability: Request your data in a structured, machine-readable format.
- California Residents (CCPA): You have the right to know what data we collect, the right to opt out of any sale (we do not sell personal data), and the right not to be discriminated against for exercising your rights.
To exercise these rights, contact us (Section 18). We will respond within the timeframe required by applicable law (typically 30 days). We may verify your identity before processing your request.
14.7 International Transfers
Your data may be stored on servers outside your country of residence. By using the Service, you consent to such transfers. Where required, we rely on appropriate safeguards such as standard contractual clauses.
14.8 Do Not Track
The Service does not respond to Do Not Track (DNT) browser signals due to the lack of an industry-wide standard.
15Cookies & Local Storage Policy
WordHammer uses browser-based storage solely to support core functionality. We do not use advertising or cross-site tracking technologies.
15.1 What We Store
- Authentication Identifiers: Secure tokens stored in your browser to maintain your session and keep you logged in.
- Preferences: Settings such as your preferred theme (dark/light mode).
- Temporary Session Data: Short-lived identifiers used to facilitate interaction with the service.
15.2 What We Do Not Use
We do not set third-party cookies, advertising cookies, analytics cookies (e.g. Google Analytics, Facebook Pixel), or any cross-site tracking cookies.
15.3 Managing Storage
You can clear localStorage and cookies at any time via your browser settings. Doing so will log you out and reset your theme preference. Disabling storage entirely may impair core functionality.
15.4 Consent
By continuing to use the Service you consent to our use of strictly necessary storage as described above. Because we use only essential storage (no analytics or advertising), explicit cookie consent banners are not required under most applicable regulations; however, we disclose this information transparently here.
16Children's Privacy (COPPA)
The Service is not directed to children under the age of 13. We do not knowingly collect personal data from children under 13. If you are a parent or guardian and believe your child under 13 has provided personal information without your consent, please contact us immediately (Section 18) and we will promptly delete that information.
Users between 13 and 18 must have verifiable parental or guardian consent before registering. By registering, you confirm that you are 18 or older, or that a parent or guardian has provided consent.
17Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Display a notice within the application on your next login.
- Where required by law, seek your express consent before changes take effect.
Your continued use of the Service after revised Terms are posted constitutes your acceptance. If you do not agree to revised Terms, please stop using the Service and request account deletion (Section 11.2).
